The Big Story: Surface Appeal

Sandusky's Lawyer & Business Ethics ? The Business Ethics Blog

Just like a defence lawyer in a criminal trial, a CEO has a specific goal to achieve. The CEO?s goal is to turn a profit, and it?s a goal rooted as much a duty to society as it is a duty to shareholders. And, importantly, when it comes to both defence lawyers and CEOs, you don?t have to agree with their goals in order to value the role they play in the larger system.

The trial of former football coach Jerry Sandusky illustrates what I?m talking about.

Jerry Sandusky?s lawyer has an unenviable job. His job is to defend?vigorously and wholeheartedly?a man that pretty much everyone else has already assumed is guilty.

Joseph Amendola, lead defence lawyer for Sandusky, has taken on the task of defending the former Pennsylvania State University assistant football coach against 52 charges of child sexual abuse. In the minds of many, this makes Amendola only slightly less worthy of scorn than his client. After all, how can anyone seriously defend a man against whom there is so much compelling evidence?

The catch here is that we cannot evaluate the ethics of a defence lawyer without looking at the bigger picture, and the bigger picture is the adversarial system within which the defence lawyer operates. Amendola isn?t just some guy defending a child molester; he?s a defence attorney playing his part in a system that places very specific ethical obligations on defence attorneys.

The point here isn?t really about the legal system. The point is that the people who play a role in a system don?t necessarily have to pursue the goals of the system directly. In fact, in some cases that would be downright counter-productive. Let?s assume, for example, that the goal of the criminal justice system is precisely what the name implies: justice. The fact that justice is the goal of the system absolutely doesn?t imply that every participant in the system has to pursue justice. Compare: a football team?s objective is to get the football into the opponent?s end-zone. But that doesn?t mean that every member of the team is trying to get the ball across that line. An Offensive Guard who focused on moving the ball would be failing at his job: his job is, pure and simple, to protect the quarterback.

What?s important in any complex institution?football team, system of justice, or a market ? is that every ?player? do his part. Then if the institution is designed reasonably well, the sum total of the actions of various ?players? will result in the system that performs well as a whole. If all the players on a football team do their jobs well, the ball moves forward toward the end zone. If all the lawyers in a system of criminal justice do their jobs well, then more often than not the guilty will be punished and the innocent will go free.

So, Amendola is duty-bound to make Sandusky?s interests his first priority. But the reason is not that Sandusky deserves it. The reason is that the system as a whole requires it. The adversarial legal system can only have any hope of rendering justice if the parts of the system diligently play their roles.

The exact same principle applies to the profit-seeking behaviour of CEOs. As Joseph Heath points out in his scholarly work on this topic, the profit-seeking behaviour of companies is an essential element of the pricing function of the Market. When companies pursue profits in a competitive environment, it helps drive prices toward market-clearing levels. This helps ensure that supply of and demand for a given product settle at the socially-optimal level. So it is important, not just to shareholders but to society as a whole, that companies pursue profits. That is how companies and their CEOs play their role in producing the social benefits that flow from the market.

Of course, in the case of both defence lawyers and corporate executives, the obligation to pursue partisan goals is not unlimited. There are certain things you cannot do as a defence lawyer?suborning perjury, for example, or tampering with evidence. Such behaviour would reliably subvert the goals of the system. Similarly, there are things that an executive must not do in pursuit of profits. Figuring out which things those are?what the limits are on competitive behaviour in an adversarial market?is the very heart of business ethics.

Concept sneakers track your dancing moves with smartphone app

Does your Lindy Hop need a little polishing before you break it out in public??These concept shoes are equipped with accelerometers that detect every step, spin, and tap, relaying your moves to a smartphone app for instant feedback.

The designer, UK-based?Tom Sykes, feels that dance was a great way for young people to exercise and learn, but existing dance products aimed at their demographic (games on the Wii and Xbox, for instance) aren't quite instructive enough. So he set out to make something new.

The result is the GroundWave Shadow, which combines a smart shoes with a smartphone. Each sneaker has an accelerometer built in, and they both connect wirelessly to an special app loaded with dance moves. As you stomp, slide, and turn, the moves are compared in real time?with what you should be doing.

How you are to keep your phone in view while popping and locking isn't addressed, but other than that, the project (still little more than a concept and prototype) seems realistic enough. Many pairs of shoes already come with sensors, like the Nike+ series, which also syncs with an app.

The futuristic shoes may never actually make it to market, but the idea is sound. You can learn more about them at the designer's site.

What Milky Way's deadly smash-up will look like

There's a lot of drama in store for the Milky Way: in 2.3 billion year's time it will graze its neighbouring galaxy Andromeda only to collide and merge with it in 5 billion years' time. Now you can preview the action in unprecedented detail thanks to a new simulation by Simon Portugies Zwart from Leiden University in the Netherlands and his team that can be paused to further explore the process.

The visualisation uses a new system to simulate gravitational forces between stars in the galaxy, allowing it to approximate the interaction of 286,000 bodies. During the Milky Way's first run in with Andromeda, a green display in the video illustrates how the algorithm works. It divides the data into 3D boxes based on the density of stars in a given area, continuously subdividing a region until there are no more than 16 stars in a box. By focusing on denser regions, the computing power required to create a realistic model is dramatically reduced compared to simulating interactions between all stars.

The team eventually hopes to use the system to simulate the evolution of stars and their clusters and planets in the Milky Way. But it should also be useful to model other processes in physics, chemistry and even finance.

No release date has been announced for the sequel, but production gets underway next month.

(AP) ? Federal safety regulators are investigating complaints that the power steering can fail on 2011 Ford Explorer SUVs.

Fifteen drivers have complained that the popular Explorer can suddenly lose its power steering assist, making it harder to steer the SUVs.

The problem could affect 83,000 Explorers. No crashes or injuries have been reported to the National Highway Traffic Safety Administration, which announced the probe on its website Friday.

In some cases, drivers reported that a warning message appeared on the instrument panel before the power steering quit. At times, restarting the SUVs corrected the problem, several drivers reported.

An investigation could lead to a recall. NHTSA said it is looking into how often the problem happens and what's causing it.

Ford is cooperating with NHTSA in the probe. Anyone who has a concern about their vehicle should contact their dealer, company spokeswoman Marcey Zwiebel said.

The Explorer, once a hulking family-hauler that helped launch the truck-based SUV boom in the early 1990s, was redesigned for the 2011 model year. The new version is based on car rather than truck underpinnings and is more efficient and maneuverable than the old one.

The new vehicle started arriving at dealers late in 2010. The company sold more than 135,000 Explorers in 2011.

Ford shares rose 1 cent to $10.28 in afternoon trading Friday. They are down 20 percent from $12.90 in mid-March.

Paul Klein: Big Art

I love watching art being installed -- and sculpture in particular. (I never understood why museums and galleries shut their spaces from public view and post "closed for installation" signs. Sure, cordon of the space to protect the art and the people, but let's let the public see what's going on. It makes art even more exciting.

The brilliant sculptor, Nancy Rubins, is in town from L.A. installing her mind-boggling, gravity defying, big sculpture on the front lawn of Navy Pier, comprised out of something in the neighborhood of 30 discarded canoes.

Every canoe is placed to play off the other canoes, and the environment, space and cityscape. This isn't the kind of art that an artist can have installed in absentia. Important decisions are made every moment to get the art the way Rubins wants it, so that when we look at it we just marvel at the impossibility.

Joesph Tabet is the producer of Big Art @ Navy Pier, a wonderful free exhibit of, just that, Big Art. He deserves our thanks for the vision of bringing Nancy Rubins' sculpture to town where it plays off of and romps with a large Roy Lichenstein sculpture of paint brushes and a bright, orange, yet somber, elegant sculpture by Sir Anthony Caro.

The Caro and the Lichtenstein have been in place for a number of weeks, but now is an opportune time to go watch canoes being levitated and to then return to see how Rubins' piece looks completed.

More large scale art will be added during the coming weeks, constituting more opportunities to see and understand how artists work and compose their pieces, as well as the order and and installation logistics necessary to pull off the magic.

Synergies abound.The Lichtenstein at Navy Pier complements the Lichtenstein retrospective at the Art Institute. The entirety of large-scale Navy Pier art resonates with Jessica Stockholder's Color Jam triumph in the Loop at State & Adams. This summer is a particularly good time for art in Chicago.

Personal Trainer Education vs. Personal Trainer Certification: Top Ten

As?the dean of the Health Fitness Specialist degree at Globe University, you can probably guess what I?m going to say in terms of education versus certification. However, I think it is important to highlight the importance of personal trainer education as well as the recent trends in the health and fitness industry. So here it is, my top ten list of reasons to pursue personal trainer education rather than simply settle for a certification:

1. If you are being entrusted to work with someone?s body, you should have a thorough understanding of anatomy, physiology, biomechanics, kinesiology?and how the various systems?of the body respond to exercise.

2. Applying force to someone?s system is an enormous responsibility and a significant number of personal trainers do so without understanding the dire repercussions. After all, adding stress to a stressed system can result in negative health results; not positive.

3. A personal trainer certification may qualify you to conduct a metabolic assessment on a client, but do you understand the science behind the assessment? Do you understand the different energy systems?

4. An increasing number of fitness center, gyms, and spas are now requiring a bachelor?s degree in exercise science, health fitness,?corporate wellness, physical fitness?or?some type of personal trainer education. In fact, The Marsh in Minnetonka was recently voted the best in terms of personal training because all of the employees have a minimum of a bachelor?s degree.

5. Individuals possessing personal trainer education credentials will likely have more opportunities for advancement? and earning potential than those simply possessing a personal trainer certification.

6.?A personal trainer certification simply cannot cover the amount of material addressed in a bachelor?s degree.

7. In this economy, revenue generation and retention is important to employers. Hiring an individual with a health fitness degree will likely translate into more revenue for the gym and longer retention for the organization.

8.? Consumers are getting smarter! Individuals hiring a personal trainer are looking for more than someone with a sense of humor, big biceps and the ability to count to ten. Many individuals new to?a gym ask for the most educated personal trainer available.

9.? Understanding how to work with special populations is increasingly important in our society. With over 40 million Americans suffering from heart disease and another 80 million suffering from diabetes, personal trainers need to understand the complexities of various health issues and how to properly work with the body.

10. The Health Fitness Specialist degree at Globe University has career placement specialists whose sole purpose is finding graduates jobs in the health and wellness field. Not just your first job, mind you; they will continue to look for work for 10, 20, even 30 years down the road! No personal trainer certification can boast lifelong dedication to career placement.

UK gives new details of mass surveillance plan

(AP) ? U.K. authorities are revealing new details of an ambitious bill which would track electronic conversations of every single U.K. resident.

The proposed mass surveillance law would collect detailed information about the private communications of millions of Britons, a step the government insists is necessary to fight terrorism and crime.

Home Secretary Theresa May says the program will not snoop on the content of the conversations. But data mining experts say that even electronic communications logs can yield detailed insights about people's lives at the stroke of a key.

Lawmaker David Davis, who opposes the plan, told BBC radio that the program would gather a "huge amount of information" and be deeply intrusive.

Details of the bill were in the process of being presented to lawmakers Thursday.

Patients who underwent chemotherapy had longer overall survival

DENVER Research presented in the July 2012 issue of the International Association for the Study of Lung Cancer's (IASLC) Journal of Thoracic Oncology, concluded that patients with limited large cell neuroendocrine tumors or with limited stage small-cell lung cancer who were treated with perioperative chemotherapy and surgery had better overall survival outcomes than patients treated with surgery alone.

Small-cell lung cancer (SCLC) represents about 15 percent of lung cancers annually. Of those, about 30 percent of patients have limited disease SCLC. Whereas large-cell neuroendocrine carcinoma (LCNEC) is a subgroup of large-cell carcinoma, that has characteristics similar to SCLC. Surgery in these groups of patients are rare and researchers wanted to know if perioperative chemotherapy would benefit the patients.

The retrospective study looked at 74 patients who underwent lung cancer surgery at the Surgical Centre Marie Lannelongue in Le Plessis Robinson, France between 1979 and 2007. Forty-five patients underwent surgery combined with perioperative chemotherapy and 29 underwent surgery alone. They found, "treatment involving surgery plus perioperative chemotherapy was associated with a significantly longer OS (overall survival) than surgery alone (6.1 years and 2.3 years, respectively)."

The authors point out that there were limitations to their study. Because the data was from 1979, the previous staging system was used. The authors also point out that, "more patients had a node involvement in the chemotherapy group, indicating that physicians may have offered chemotherapy to patients with more advanced disease." However, no conclusion could be made because of the, "small population examined in this study, its retrospective nature, the difference in follow-up between the two groups and the heterogeneity of the combined treatments."

The authors point out that due to the rarity of this population, a prospective trial is unlikely to be feasible and these retrospective data may be of value.
